These Terms govern your use of the Maiya Intelligence website, client portal, BI tools, subscriptions, and professional services. By accessing or using our services, you agree to these Terms.

Scope

Maiya Intelligence provides analytics, business intelligence, automation, marketing support, web and digital services, software-related implementation, subscriptions, and related consulting. These Terms apply to the website, account area, BI tools, chatbot, invoices, quotes, and all related services unless a separate written agreement states otherwise.

If a signed proposal, statement of work, order form, or separate client agreement conflicts with these Terms, the specific written agreement will control for that engagement.

Accounts and eligibility

  • You must provide accurate and current information when creating an account or placing an order.
  • You are responsible for maintaining the confidentiality of login credentials and for activities that occur under your account.
  • You must promptly notify us if you believe your account, payment method, or authentication credentials have been compromised.
  • You must be legally able to enter into a binding agreement to use our services.

Services and deliverables

  • Service scope, timing, pricing, deliverables, usage limits, implementation assumptions, and dependencies may be described on the website, within a proposal, or in written communications.
  • Custom work may require timely access, approvals, content, data, credentials, and feedback from you.
  • We may use automation, software tools, analytics platforms, and AI-assisted workflows to help deliver services, provided this remains consistent with our obligations to you.
  • Unless explicitly agreed otherwise, project timelines are estimates and may change based on dependencies, data quality, approvals, third-party platforms, or changes in scope.

Billing, invoices, and payments

  • Fees are payable in the currency and billing cadence shown at checkout, in an invoice, quote, or written agreement.
  • We may use third-party payment processors to collect and process payment details securely. We do not intentionally require full card storage on our own systems unless a processor provides a secure tokenized storage method for future payments at your request.
  • You authorize us and our payment processors to charge the selected payment method for subscriptions, renewals, one-time purchases, taxes, and other agreed fees.
  • Invoices, official invoice PDFs, payment confirmations, and related billing notices may be sent electronically.
  • Late, failed, or disputed payments may result in service suspension, restricted account access, cancellation of orders, or delayed delivery until the balance is settled.
  • Refunds and cancellations are governed by our Refund Policy, unless a separate written agreement states otherwise.

Customer responsibilities

  • You are responsible for the legality, accuracy, and quality of the data, content, files, and instructions you provide to us.
  • You must have the rights and permissions required for any materials, data sources, integrations, trademarks, or accounts you ask us to use.
  • You remain responsible for business decisions made using analytics outputs, dashboards, forecasts, AI suggestions, campaign recommendations, or automation results.

Acceptable use

You may not misuse the website or services. Without limitation, you may not:

  • attempt unauthorized access, interference, scraping, reverse engineering, credential attacks, or security testing without written permission;
  • upload or transmit unlawful, infringing, defamatory, malicious, deceptive, or harmful content;
  • use the services to spam, harass, stalk, distribute malware, infringe rights, or violate applicable law;
  • resell, sublicense, mirror, or exploit the services in a way not authorized by us in writing.

Intellectual property

We retain ownership of our pre-existing materials, know-how, methods, software components, templates, branding, and general service frameworks. Subject to full payment of applicable fees, you receive the rights expressly granted in the relevant order, proposal, or agreement for the deliverables prepared for you.

You retain ownership of the materials and data you provide to us, and you grant us the limited rights needed to host, process, use, and modify them as necessary to provide the services.

Third-party services and sign-in

Our services may interoperate with or rely on third-party services such as hosting, payment providers, analytics tools, advertising platforms, communication tools, Google authentication, and client-requested integrations. Your use of those third-party services may also be subject to their own terms and privacy notices.

We are not responsible for outages, data loss, policy changes, pricing changes, access restrictions, or actions taken by independent third-party services that we do not control.

Disclaimers

Except as expressly stated in a written agreement, the website and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.

We do not guarantee specific business outcomes, revenue increases, campaign results, search rankings, data completeness, uptime levels, or uninterrupted access unless expressly agreed in writing.

Limitation of liability

To the maximum extent permitted by law, Maiya Intelligence will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business interruption arising out of or related to the services.

To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the services will not exceed the total amount you paid to us for the specific service giving rise to the claim during the 12 months before the event giving rise to liability.

Nothing in these Terms excludes liability that cannot legally be excluded, including mandatory consumer rights where applicable.

Suspension and termination

We may suspend or terminate access to the website or services if you materially breach these Terms, fail to pay amounts due, create security risk, misuse the platform, or where suspension is reasonably necessary to protect the business, other users, or third parties.

You may stop using the website at any time. Subscription cancellation and refund rights are addressed in the Refund Policy or applicable written agreement.

Governing law

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules, except to the extent mandatory local consumer or privacy laws require otherwise. The competent courts of Portugal will have jurisdiction unless applicable law provides another mandatory forum.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the services after the effective date of the revised Terms means you accept the updated Terms, except where a different acceptance method is required by law.
